GENERAL TERMS & CONDITIONS OF SALE

ARTICLE 1: SCOPE

These General Terms & Conditions of Sale apply to all sales made through the website www.algo-ritme.com/en between a website user, hereinafter the “Customer”, and Kenyio Europe BV, hereinafter “AKenyio”, a company with registered capital of 20,000 EUR, whose registered office is located at Vogelenzangstraat 140, 3070 Kortenberg, Belgium, with VAT number BE 0745.538.238

The act of placing an order implies that the Customer accepts these General Terms & Conditions of Sale, completely and without any reservations. No agreement or commitment, without the formal written acceptance of Kenyio, may prevail over these Terms & Conditions of Sale. Any contrary clause put forward by the Customer shall, in the absence of express acceptance by Kenyio, be unenforceable against Kenyio, regardless of when it may have become aware of such clause put forward by the Customer.

ARTICLE 2: PRICE

Prices shown are in euros and are inclusive of all taxes in the sending country, excluding shipping costs. They may be subject to modifications. The items ordered are billed on the basis of the price in force at the time the order is registered.
The price is payable at the time of the order, in full and in a single payment. All orders are billed in euros and payable in euros. For deliveries outside the Belgium, any customs fees or local taxes remain the responsibility of the recipient.

ARTICLE 3: ORDERS

Orders may be made on the website www.Kenyio.com/en.
The contractual information is presented in English and acceptance will be confirmed, at the latest, at the moment your order is validated.
Kenyio reserves the rights to not register a payment and/or to not confirm an order for any reason, particularly in the event of a supply problem or any difficulty relating to the order received.

ARTICLE 4: SHIPPING CHARGES.

Shipping charges include a flat fee for the costs of handling and shipping. They are the Customer’s responsibility and are billed at the end of the order process, added to the costs of the products being purchased. They are applicable for shipping within the countries mentioned on the website

ARTICLE 5: PAYMENT

The Customer may pay for his or her order:

by all methods of payment in the MOLLIE environment, securely and without having to create an account.

ARTICLE 6: ORDER PROCESSING

From Monday to Friday, orders placed before 14:00 are processed the same day and shipped within 3 to 5 working days. In the event of a delay in preparing an order, the Customer will be notified via email. In such an event, and as long as the order has not yet been shipped, the Customer will be able to cancel the order and be reimbursed in full.

ARTICLE 7: RETRACTATION

In accordance with the provisions of the consumer laws, the Customer has a retraction period of 14 days from the date of receipt of the products, during which the Customer may exercise his or her right of retraction without having to justify such retraction or pay any penalty.
Returns are to be made in their original and complete state (including all packaging, accessories, usage instructions, etc.) This is the Customer’s responsibility. Any damage to the product in such cases may constitute a waiver of the right of retraction.

The product should be sent in its original packaging, at the Customer’s expense, to the following address:

In the event of an exercise of the right of retraction, Kenyio will proceed to refund the amounts paid, within a period of 14 days following notification of the Customer’s request.
Such refund may be made via a bank transfer.

ARTICLE 8: AVAILABILITY

Kenyio’s products are offered as long as they are shown on the website www.algo-ritme.com. In the event that products become unavailable after the Customer’s order has been placed, Kenyio will inform the customer via email. The Customer’s order will be automatically cancelled, and no bank debit will be made.

ARTICLE 9: COMPLAINTS.

All complaints or requests for exchanges or refunds must be submitted to the email address info@algo-ritme.com within a period of 14 days after delivery.

The products must be returned to Kenyio in the state in which the Customer received them, including all of their elements (e.g., accessories, packaging, usage instructions, etc.)
The provisions of this Article do not prevent the Customer from exercising the right of retraction under Article 7.

ARTICLE 10: LIABILITY.

Kenyio cannot be held liable for damages resulting from improper usage of any purchased product.
Additionally, Kenyio cannot be held liable for any inconvenience or damage relating to the use of its website(s), such as a disruption in service, a third-party intrusion, or the presence of computer viruses.

ARTICLE 11: TRANSFER OF OWNERSHIP

The transfer of ownership of the products in favor of the Customer shall happen only after the price has been paid in full by the Customer, regardless of the date of delivery of the products in question. On the other hand, the transfer of risk of loss or spoilage of the products shall happen upon receipt by the Customer of the products in question.

ARTICLE 12: APPLICATION LAW.

The language of the present contract is English. These terms and conditions of sale are subject to Belgian law. In the event of a dispute, the courts of Belgium shall have exclusive jurisdiction.

ARTICLE 13: INTELLECTUAL PROPERTY

All elements of the website www.algo-ritme.com are and remain the exclusive intellectual property of Kenyio. No one is authorized to reproduce, redistribute, or otherwise make use of any element of the site, be it software, visual, or audio, for any purpose, in whole or in part. Any simple or hypertext link is strictly forbidden without the express written consent of Kenyio.

ARTICLE 14: PERSONAL DATA

Kenyio reserves the right to collect personal data and information regarding website users. These data and information are necessary for managing each Customer’s order, as well as for improving the services and information that we offer our users. They may also be transmitted to companies that contribute to these relationships, as well as to those responsible for carrying out services and orders, for purposes of management, execution, processing, and payment.
These data and information are also kept for security purposes, in order to comply with legal and regulatory requirements.

ARTICLE 15 : RECORDS

Kenyio will keep records of purchase orders and bills on a reliable and durable medium, representing faithful copies.

Kenyio’s computerized records are hereby considered by all concerned parties to be evidence of the communications, orders, payments, and transactions between the parties.

SECURE PAYMENT

At Kenyio, payment security is very important to us.

Kenyio uses SSL encryption to protect both your data and your payment method. (This can be confirmed by the “https” in the URL in your browser’s address bar.)

We use the payment security protocol MOLLIE, which guarantees complete confidentiality of personal information transmitted over the internet.

We also accept payment via Paypal, a simple, fast, and secure service for sending and receiving money online without requiring that any bank account details be provided.
